Construction Law
The firm represents owners, developers, public agencies, contractors, subcontractors, and material suppliers in all phases of the construction process, including: (1) negotiating public and private engineering, architectural, construction, and subcontract agreements; (2) advising clients during the course of construction and construction closeout; (3) initiating and defending construction lien claims; and (4) resolving and litigating construction disputes and resulting insurance and bond issues.
Our construction counseling practice has grown out of our general representation of developers, owners, contractors, and public agencies. We provide specialized, experienced service in negotiating and documenting design and construction arrangements, including bids, contracts, specifications, and joint venture arrangements. We also represent major contractors and subcontractors, including one of the largest electrical contracting firms in the nation. Our representation in the construction contracting field has covered a wide range of projects, including high-technology computer plants, office parks, hotels, high rises, residential subdivisions, loft conversions, and major league sports stadiums.
We are experienced in advising on and handling construction disputes such as bid disagreements, change order claims, contract disputes, late delivery, lien and bond claims, construction/design defects, and warranty claims. Our lawyers have assisted owners, developers, public agencies, contractors, and material suppliers in negotiating, mediating, arbitrating, and litigating all types of public and private construction disputes. Our representation in construction disputes covers a wide range of clients (including major real estate developers, building owners, high-tech companies, commercial landlords, yacht owners, equipment owners, and major contractors and subcontractors), and a wide range of substantial projects (including large-scale developments, hotels, warehouses, manufacturing facilities, retail pads, condominium buildings, high rises, state buildings, and large machines). We have handled such cases in both state and federal courts and various arbitration venues.
We are well known for successfully asserting claims for insurance recovery of construction disputes against insurance carriers. We have significant expertise in positioning these cases in a manner that triggers insurance recovery to pay for attorneys’ fees and losses. Deploying this expertise is consistent with our aggressive approach to handling construction cases.
