Annexation Overturned

The City of Beaverton, Oregon involuntarily annexed a client’s land, resulting in changed regulatory and taxation standards, to the client’s detriment. Jack Orchard briefed and argued, in a case of first impressions, that this “forced annexation” was illegal under Oregon statutes. Both the Oregon Court of Appeals and the Oregon Supreme Court agreed, totally reversing the City’s action and also resulting in a significant tax refund to the client.
