Four Single-Family Homeowners Prevail in 8-Day Jury Trial Against Siding Subcontractor

Adele Ridenour represented homeowners in claim for negligent construction against sider

In February 2016, Adele J. Ridenour, a partner in Ball Janik LLP’s construction litigation group, represented the owners of four single-family homes in prosecuting a claim for negligent construction against their original sider. The case, known as Dahl v. Newside, Inc., resulted in an 8-day jury trial in Washington County Circuit Court. After only a few hours of deliberation, the jury held the sider was between 58-90% responsible for the defects plaguing the owners’ homes, and awarded damages of between $37,000-$48,000/house.

The jury’s verdict was more than four times the sider’s last settlement offer and even exceeded the plaintiffs’ own pre-trial demand.
